Terms of Service

These are sample terms. They are provided as a placeholder while Hey Swarm is in early access. Final terms drafted by counsel will replace this document before general availability. By using Hey Swarm during this period, you agree to the terms below.

1. Acceptance of Terms

By accessing or using Hey Swarm ("the Service"), operated by Hey Swarm LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Hey Swarm is a virtual office platform that lets you connect, configure, and orchestrate AI agents ("Swarmies") on your behalf. The Service is provided "as is" during early access and may change at any time.

3. Your Account

You must provide a valid email address to create an account. You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any law or regulation;
  • Infringe on the intellectual property or privacy of others;
  • Distribute malware, spam, or harmful content;
  • Attempt to gain unauthorized access to the Service or its underlying systems;
  • Reverse-engineer, scrape, or resell the Service without our written permission.

5. Your Content and AI Agents

You retain ownership of any content, prompts, or configurations you submit to the Service. You grant us a limited license to process that content solely to operate the Service for you. You are responsible for the actions of any AI agents you connect, including the outputs they produce and the API costs they incur with third-party providers.

6. Third-Party Services

Hey Swarm integrates with third-party AI providers (Anthropic, OpenAI, Google, etc.) and other tools. Your use of those services is governed by their own terms. We are not responsible for their availability, accuracy, or pricing.

7. Beta Disclaimer

Hey Swarm is currently in early access. Features may be incomplete, unstable, or removed without notice. Do not rely on the Service for production-critical workflows during this period.

8. Limitation of Liability

To the maximum extent permitted by law, Hey Swarm LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the prior twelve months (or USD $100 if you have not paid us anything).

9. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these terms or if we discontinue the Service.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or an in-product notice. Continued use of the Service after a change constitutes acceptance.
